These Terms and Conditions govern access, browsing and use of the website montado.pt, as well as the purchase and sale of products through the online store by final consumers.
By using this website and/or placing an order, the user declares to have read, understood, and accepted these Terms and Conditions.
A Montado sells physical cork products through its online store, including, but not limited to, bags, wallets, footwear, fashion accessories, and homeware.
The images, photographs, descriptions, and other informational elements presented on the website are intended to illustrate the products as faithfully as possible. However, given the nature of the materials used, particularly cork, there may be slight variations in colour, texture, pattern, finish, or shade between the products presented on the website and the products actually delivered, without this constituting a defect or lack of conformity.
Creating a customer account on the website is optional, but may be necessary to access certain features, such as viewing order history, managing personal data, and tracking orders.
The client is responsible for ensuring the confidentiality of their access data and for all activities carried out through their account.
Montado reserves the right to suspend or terminate user accounts in case of misuse, provision of false information, violation of the law, or breach of these Terms and Conditions.
The presentation of products on the website does not dispense with confirmation of availability and does not constitute, in itself, a binding contractual offer.
To place an order, the customer must select the desired products, add them to the shopping cart, fill in the requested details, choose the shipping and payment method, and complete the order.
The order is only considered received upon successful submission on the website. Montado will send an automatic order acknowledgement to the email address provided by the customer.
The Montado reserves the right not to accept or to cancel orders, particularly in the following cases:
a) Product unavailability;
b) manifest error in the price, description or characteristics of the product;
c) suspected fraud or misuse of the website;
d) impossibility of processing or delivery;
prior non-compliance by the customer.
B2C orders are limited to stock available at the time of purchase.
In the event of the subsequent total or partial unavailability of an ordered product, the Montado will inform the customer as soon as possible and will proceed, where applicable, to refund the amounts paid in relation to the unavailable product.
The Montado also reserves the right to limit the quantities of products that can be purchased per customer, per order or per period of time, whenever this is deemed necessary for stock reasons, fairness between customers, prevention of unauthorised resale or operational reasons.
The prices shown on the website are indicated in euros and include VAT at the applicable legal rate, unless expressly stated otherwise.
The prices applicable will be those in force at the time of order confirmation.
The Montado may alter prices, shipping costs, promotions, and commercial campaigns at any time, without prejudice to orders already validly submitted and confirmed.
For sales to destinations outside Portugal, including other Member States of the European Union and third countries, the applicable tax treatment may vary depending on the destination country, the nature of the transaction, the customer's circumstances, and the legislation applicable in each jurisdiction.
In the case of orders shipped to countries outside the European Union, the recipient may be subject to the payment of customs duties, import VAT, customs fees, or other local charges applicable in the destination country, which are the sole responsibility of the customer. The rules for pre-contractual information on total price, charges, and return costs are governed by the distance contract regime, and the right of withdrawal is generally 14 days, with exceptions such as personalised goods.
Montado offers the following payment methods for B2C purchases:
Electronic payments are processed through third-party payment service providers, namely Stripe e Ifthenpay, or other providers that may be used by Montado.
For orders where the Multibanco payment method by reference is selected, items will be reserved for a maximum of 48 hours after the order is placed. If payment is not made within this period, the order will be automatically cancelled and the items will become available for sale again.
Montado reserves the right to cancel orders where payment is not successfully processed.
The Montado issues an invoice for all purchases made through the online shop.
The customer may provide their billing details at the time of purchase. The entry of the NIF by the customer is optional, except in cases where its collection is legally or operationally necessary.

The indicated deadlines are merely estimates and are generally counted in working days from the shipment of the order. There are no regular shipments or deliveries on Saturdays, Sundays, and public holidays, unless otherwise indicated by the carrier.
Orders can be submitted 24 hours a day, 7 days a week, but processing is only carried out on weekdays.
Montado does not deliver to PO boxes.
A tracking code will be provided to the customer whenever available, allowing them to track the shipment.
Unless special campaigns or conditions are in place, the applicable delivery charges are as follows:
Montado may review shipping costs at any time, without prejudice to orders already completed.
The customer is responsible for correctly providing all necessary delivery details, including name, full address, postcode, country, and contact information.
If an order is returned to the sender due to reasons attributable to the customer, such as an incorrect or incomplete address, absence of the recipient, failure to collect the order within the timeframe indicated by the carrier, or unjustified refusal to accept it, Montado may:
a) request payment for new shipping costs to proceed with reshipment; or
b) accept the cancellation of the order and proceed to refund the amount paid, deducting the initial shipping costs and any return charges levied by the carrier.
The customer may request to cancel the order while it is in the processing or preparation stage.
If payment has already been made and the cancellation is accepted before dispatch, Montado will proceed with the respective refund.
Once the package has been dispatched, administrative cancellation is no longer possible, without prejudice to the exercise of the right of withdrawal where legally applicable.
In distance contracts concluded with consumers, the customer generally has the right of withdrawal within the period of 14 days from the day of physical possession of the goods, without needing to state the reason.
To exercise this right, the customer must communicate their decision to Montado, within the aforementioned period, via email geral@montado.pt, indicating, at a minimum, the order number and the identification of the product(s) to be returned.
Following the exercise of the right of withdrawal, the customer must return the goods to the following address:

Unless Montado agrees to bear such costs or the law provides otherwise, the direct costs of return in the event of withdrawal shall be borne by the customer.
The customer shall store and handle the goods diligently and may inspect them only to the extent necessary to ascertain their nature, characteristics and functioning. The return should be made, whenever possible, with the original packaging, manuals, accessories and proof of purchase, however, the mere absence of original packaging shall not automatically exclude the right of return when it exists under the terms of the law.
Notwithstanding other legally provided exclusions, there is no right of withdrawal in relation to goods made to the customer's specifications or that are clearly personalised.
Therefore, personalised products or those made specifically for the customer cannot be returned or exchanged, except in cases of defect, error attributable to Montado or legally recognised non-conformity.
A Montado accepts returns within the applicable legal framework.

Montado does not offer direct exchanges. Where applicable, the customer must return the product and, if desired, place a new order.
When the return results from an error by Montado, sending the wrong product, product damaged on arrival, or legally recognised non-conformity, the return costs shall be borne by Montado.
When the return is due to the customer's mere regret and there is a right of withdrawal, the return costs shall be borne by the customer, unless otherwise expressly indicated.
Upon receipt of the returned item, Montado will proceed with its verification. Once the return is confirmed to comply with the applicable legal and contractual conditions, the refund will be issued via the same payment method used for the purchase, unless otherwise expressly agreed.
Without prejudice to the applicable statutory period, Montado will endeavour to process the refund, as a general rule, within a maximum period of 5 working days Upon receipt and validation of the returned item. In distance contracts, the trader must refund the consumer within the applicable legal timeframe, and may withhold the refund until receipt of the goods or proof of their dispatch.
Under applicable law, the Montado is responsible for any lack of conformity of the goods that manifests itself within the period of three years from the delivery of the good to the consumer. If the lack of conformity becomes apparent during the first two years, it is presumed to have existed at the time of delivery, unless proven otherwise. In case of non-conformity, the consumer may be entitled to repair, replacement, an appropriate price reduction or termination of the contract, in accordance with applicable law.
To report a defect or non-conformity, the customer should contact Montado via the general email address at @montado.pt, providing the order or invoice number and, whenever possible, attaching photographs of the product.
Following an analysis of the situation, the Montado will inform the customer about the appropriate procedures, including, where applicable, collection, replacement, repair, price reduction or contract termination, in accordance with the law.

Montado may offer promotional campaigns, discount vouchers, welcome offers for the newsletter, and other commercial actions.
Each campaign or coupon may be subject to specific terms of use, including expiry dates, eligible products, minimum purchase values, and limitations on accumulation with other offers.
Unless otherwise indicated, vouchers are not redeemable for cash and may only be used once per customer or order, under the stated terms and conditions.
The brand Montado® it is a registered trademark and legally protected at a national and European level, and is also protected, where applicable, in various countries outside of Europe.
All website content, including but not limited to, text, images, photographs, videos, graphics, logos, design, layout, trademarks, trade names, distinctive elements, files, software and other materials, are the property of Montado or of third parties who have authorised their use.
Reproduction, distribution, modification, use, public communication, extraction, reuse, or exploitation, in whole or in part, of any content on the website is prohibited without prior express written authorisation from Montado, except in cases permitted by law.
The user undertakes to use the website lawfully, diligently and responsibly, refraining from carrying out acts that may affect the security, availability, integrity or functioning of the website, its content or the underlying systems.

Montado will not be liable for indirect damages, loss of profits, loss of opportunity, or losses resulting from temporary unavailability of the website, failures of communication networks, third-party service interruptions, viruses, cyberattacks, or force majeure events, except in cases of wilful misconduct or gross negligence, and without prejudice to the mandatory rights of the consumer.
In the event of a manifest and obvious error in the price or essential characteristics of a product, Montado reserves the right to cancel the order before dispatch, with a full refund of any amounts paid.
The Montado shall not be held liable for non-performance or delay in the performance of its obligations when such is due to events of force majeure, acts of God, or circumstances beyond its reasonable control, including, without limitation, strikes, labour disputes, pandemics, power failures, transport disruptions, customs blockades, armed conflicts, fires, floods, natural disasters, system failures, or subsequent legal restrictions.
